This Subscriber Agreement is for Cable TV of Belzoni High Speed Internet Subscribers. Acceptable Use Policy from now on referred to as AUP.

By using our service and/or viewing this agreement and/or our main webpage you agree to the following terms:

The cable modem service is a broadband service and the transfer speeds are not guaranteed at all times. This is a best-effort service to the service level you subscribe to. The actual speed experienced by the customer may very and depends on several factors including customer location, destination on the internet, traffic on the internet, frequency interference. No minimum level of speed is guaranteed.

Viewing and downloading material from the internet is solely at the risk of the subscriber. Cable TV of Belzoni is not responsible for the content viewed and/or downloaded to the subscribers computer system. Furthermore, Cable TV of Belzoni is not responsible for viruses or intrusions to the subscribers computer system. This is the subscribers sole responsibility.

User agrees to use Cable TV of Belzoni Cable Modem services for lawful purposes only and not to annoy or harass other Internet users. (Cable TV of Belzoni Inc. will be the sole judge as to what constitutes annoying acts or harassment.)

Tech Support:

Cable TV of Belzoni does not authorize tech support from third party companies concerning our Internet Service. If you think you are having trouble with your internet connection, Cable TV of Belzoni must be contacted to verify the problem. Cable TV of Belzoni reserves the soul right to verify this prior to any third party attempting to troubleshoot your connection or your computer for internet related problems. Other tech support services including online support from third party companies other than Cable TV of Belzoni for your internet service is strictly prohibited and constitutes a breach of this agreement. This is for your security as well as the security of our internet service.

SPAM:

Cable TV of Belzoni, Inc. Subscribers agree not to engage in SPAM activities. SPAM-Generally referred to as the Internet equivalent of junk mail, spam ranges from annoyances such as mass emailings and advertisements, junk mail, chain letters, and off-topic newsgroup postings to scam letters, fraudulent product or service promotions, and harassing or threatening emails. Cable TV of Belzoni, Inc. has a zero-tolerance policy against spamming. Participating in spam will result in permanent cancellation of your account, period. There is no recourse for such actions.

File Transfers:

Subscriber agrees not to transmit any material in violation of any federal or state law or local ordinance. This includes, but is not limited to, copyrighted material, material protected by trade secret, or any material that is determined to be threatening or obscene. Cable TV of Belzoni, Inc. reserves the right in its sole discretion to delete any information entered onto Cable TV of Belzoni, Inc. system by subscriber. Any site that is commercial in nature is subject to a hosting fees." This includes hosting a page from your machine while connected to our system and collecting e-mail, chat or other means of communication intended for the purpose of selling, marketing and conveying a message with the intent of marketing or selling a product or service."

User agrees to defend, indemnify and hold harmless Cable TV of Belzoni, Inc. its affiliated companies, employees, agents and licensees from all liabilities, claims and expenses. Including attorney's fees, arising as a result of any breach of the AUP (acceptable use policy) or service/subscription agreement. Or any illegal, unlawful or unauthorized use of Cable TV of Belzoni Inc.'s services, networks or systems.

Termination:

Cable TV of Belzoni Inc. reserves the right to immediately suspend an account on reasonable suspicion of violating this AUP while it is being investigated and to terminate the account if proven. Violators of this AUP will be billed for any costs incurred in dealing with them. Users whose accounts are terminated for violating this AUP are not entitled to a refund of any prepaid fees.

Cable TV provides a cable modem to each subscriber on a rental fee system which is included in the monthly fee. This cable modem is the sole property of Cable TV of Belzoni, Inc.. Connecting to the internet through this device is solely at the risk of the subscriber. The cable modem must be returned to Cable TV of Belzoni, Inc. in good working condition, when a subscriber terminates its account with Cable TV of Belzoni, Inc. Monthly fees for service will be continued until the modem is returned.

Use of a Cable TV of Belzoni, Inc. account to disable, harm or attempt to harm another computer via the Internet or with User's access account is strictly forbidden. Termination of account and prosecution to the fullest extent of the law will result.

Cable TV of Belzoni, Inc. may modify this policy at anytime without prior notice given. Use of account and viewing www.belzonicable.com constitutes users acceptance of policy implied in fact.
